The injustice within the justice system
The debate on fundamental and human rights has been, to some extent, overdone. However, the following article gives the issue quite a distinct flavour. THe writer posits that Constitutional protection of those rights will never be realised, unless and until judges, in the exercise of their power and discretion, are brought within the ambit of Constitutional law. This article discusses he issues against the Naturalist/Positivist debate.
