Control of Cartels, Abuse of Dominance and Mergers: The French Experience

Abstract

This paper examines how in a country with a strong State-intervention tradition, a system of free competition and control of the cartels, abuses of dominance and mergers, has been set up in the last decades.

Since the paper is written with a special concem for readers in the Caricom, it has to be stressed that the French experience is absolutely not original nor unique within the European Union context: surely, the French system has its peculiarities, reflecting the national legal tradition. as all national competition law and policy systems do all over the world. But, on the whole, it is fully convergent and consistent with the systems to be found within all EU member States such as Germany. Italy. Spain, Portugal, the Netherlands or even the United Kingdom.
